Q: What is subrogation?
A: Subrogation is a legal concept under common law where one party (the insured) transfers their rights of recovery to another party (the insurance company) granting that party the right to recover damages from a different third party tort-feasor.

Q: What is inter-company arbitration?

A: Inter-company arbitration is a cost effective alternative to traditional litigation for insurance companies.  Instead of filing suit against each other, signatory members agree to resolve their disputes by submitting their cases to a panel of insurance professionals.  That panel reviews the case and then makes a decision regarding fault and awards damages accordingly.  The arbitration panel’s decision is legally binding and enforceable in court.  This arbitration group is reserved solely for insurance companies and is considerably more cost and time efficient than traditional litigation.
